Even if you qualify for the Compassionate Care Benefit, you want to be sure that your employer will keep your job for you while you are away. Under the Employment Standards Act, the Family Medical Leave allows employees to take up to eight weeks of leave to care for certain family members. This is an unpaid leave, so although your job is protected, your employer does not pay you while you are away. A qualified medical practitioner must issue a certificate. Even if you do not qualify for the Compassionate Care Benefit, you may still be able to take an unpaid Family Medical Leave.

This may be taken for illness, injury or medical emergency of an employee, or to provide care for certain family members or relatives who are dependent on you for care and assistance. It is an unpaid, job-protected leave that allows you to take up to ten days per calendar year away from work, in workplaces of over 50 employees.
